CONDIZIONI DI NOLEGGIO – ESCURSIONE EGADI BOATING:

  1. The reservation of the excursion/charter is considered confirmed upon receipt of payment.
  2. Free cancellation via email to info@egadiboating.com up to 7 days before the service.
  3. Changes to the requested service (excursion/charter) without refund are possible from 7 days up to 3 days before the service, SUBJECT TO AVAILABILITY and limited to the services offered on www.egadiboating.com.
  4. In the event of adverse weather and sea conditions that, in Egadi Boating’s assessment, do not allow the service to take place, the customer will be entitled to a full refund OR the possibility to reschedule (subject to availability).
  5. The excursion itinerary may be changed at the skipper’s discretion depending on sea/weather conditions or other navigation or mooring needs. Egadi Boating will not be held responsible in any way for itinerary changes, stops, time losses, and/or interruptions resulting from decisions made by the skipper for the safety of the navigation.
  6. The departure time of the excursion must be respected as agreed at the time of booking. Delays of more than 15 minutes (without prior telephone notice) are not allowed and will result in the loss of the excursion without any refund.
  7. Skipper service is included in the price.
  8. In case of WITHDRAWAL by EGADI BOATING due to force majeure or other strictly personal, unforeseeable, and non-deferrable reasons (e.g., health issues), EGADI BOATING shall immediately notify the Customer and, if possible, propose an alternative to the Customers that does not change the means of transportation used to reach the embark point (and return from the disembark point); otherwise, the customer may choose to be refunded the paid amount without any penalty to EGADI BOATING.
  9. Egadi Boating commits to providing the Guests with a clean, fully functioning boat, compliant with current regulations, and equipped with all safety equipment required for the type of navigation to be carried out.
  10. The Guest agrees to inform Egadi Boating, prior to boarding and confidentially, of any health issues, drug or food allergies, or other specific personal needs.
  11. Each participant is solely responsible for their belongings and personal items and shall be liable in case of theft, loss, or damage. They are also responsible for any damage caused to the boat due to intentional or negligent behavior or disregard of the instructions provided by the skipper.
  12. Egadi Boating declares that it has signed all legally required insurance policies.
  13. The Guest boards with full awareness of the risks and dangers that a boat excursion may involve. In case of injury not caused by the skipper’s fault or responsibility, no compensation may be requested from either the skipper or Egadi Boating.
  14. If the Guest cannot swim or has other personal limitations, they must inform the skipper and accept any precautionary measures that the skipper deems necessary for their safety and wellbeing.
  15. The Guest declares to have been informed and to be fully aware of the characteristics of the excursion, the boat, and the number of people allowed onboard.
  16. The skipper has the right, for the safety and wellbeing of all Guests, to disembark anyone who behaves improperly, disrupts the peaceful enjoyment of the excursion, causes damage or disturbance to other Guests, or in any way compromises their peace and safety.
  17. Luggage brought onboard must be limited and essential, packed in small, non-bulky bags that allow proper stowage.
  18. For anything not covered by this agreement, reference is made to applicable Italian Laws.
  19. Any dispute arising from this agreement shall be under the exclusive jurisdiction of the Court of Trapani.
  20. Privacy: The data provided as part of this contract will be stored and processed by Egadi Boating (as data controller) exclusively for contractual and accounting purposes, in full compliance with the Italian Data Protection Code, Legislative Decree no. 193/2003.
  21. Signing this contract constitutes consent by the Charterer, also on behalf of the Guests, pursuant to Article 26 of the aforementioned Legislative Decree, to the processing of such data, declaring to have been fully informed of their rights under Article 13 of Legislative Decree no. 193/2003.
